Octaviano Ortiz is a caring partner and father of 4 US Citizens who has been living in the United States since 1999. On January 2010, Ortiz was arrested for driving under the influence of alcohol, a charge that became “aggravated” in the state of Illinois due to Octaviano being undocumented and therefore not having a drivers license. Due to the higher standards undocumented immigrants are put in under the legal system, Ortiz was processed at Cook County Jail and then referred to ICE custody. Soon after ICE released Ortiz on his own recognisance but placed Octaviano under deportation proceedings. As a result of his DUI charge and out of care for his family, Ortiz enrolled in the Healthcare Alternative System, where he was able to complete aftercare programs to address his health.
Ortiz is a father of four young children, Andrea who is 14, Alexandra who is 11, Ismael who is 6, and Giovanni who is 2 with his partner of almost two decades who depends on Octaviano economically and emotionally. The youngest, who was born in 2020, was born after only 5 months of pregnancy and needs constant care by both parents as well as therapy three times a week to ensure his well being. If deported, Octaviono would be separated from his entire family, leaving behind his 4 children and partner Martha in order to sustain care for their children. This forced displacement would result in significant impact in accessing medical attention for their youngest child, and trauma on the whole family.
Based on Secretary of Homeland Security Alejandro Mayorka’s latest memo, it is clear that Octaviano Ortiz does not fit the priorities set by the Department of Homeland Security for deportation and should be granted prosecutorial discretion that would allow Ortiz and his family to stay together in the US. Help demand that this loving father be able to stay with his four young children safely together, at home, close to their community, doctors, and family. Deporting Ortiz will further jeopardize the well being of his children, endanger his life, and our communities will be made weaker. We seek to have Ortiz's and his community's well-being prioritized instead. We seek to keep the integrity of his family remaining whole in Chicago.
Octaviano Ortiz es un padre de 4 Ciudadanos Estadounidenses y una pareja cariñosa que ha vivido en los Estados Unidos desde 1999. En enero de 2010, Ortiz fue arrestado por conducir bajo la influencia del alcohol, un cargo que se “agravó” en el estado de Illinois debido a que Octaviano es indocumentado y por lo tanto no aver tenido una licencia de conducir. Debido a los estándares que suelen ser más altos en el sistema legal para inmigrantes indocumentados, Ortiz fue procesado en la cárcel del condado de Cook y luego remitido a la custodia de ICE. Poco después, ICE liberó a Ortiz bajo su propia responsabilidad, pero colocó a Octaviano bajo proceso de deportación. Como resultado de el DUI y por el amor de su familia, Ortiz se pudo inscribir en el Sistema Alternativo de Salud, donde pudo completar programas de atención posterior para abordar su salud.
Ortiz es padre de cuatro niñez, Andrea de 14 años, Alexandra de 11, Ismael de 6 y Giovanni de 2 con su pareja de casi dos décadas que depende económica y emocionalmente de Octaviano. El menor, que nació en 2020, nació con solo 5 meses de embarazo y necesita cuidados constantes por parte de ambos padres, así como terapia tres veces por semana para garantizar su bienestar. Si es deportado, Octaviano sería separado de toda su familia, dejando atrás a sus 4 hijes y su pareja Martha para poder sostener el cuidado de sus hijes. Este desplazamiento forzado tendría como resultado un impacto significativo en el acceso a la atención médica para su hijo menor y causaría trauma para toda la familia.
Basado en el último memorando del Secretario de Seguridad Nacional Alejandro Mayorka’s, está claro que Octaviano Ortiz no se ajusta a las prioridades establecidas por el Departamento de Seguridad Nacional para la deportación y se le debe otorgar discreción fiscal que le permita a Ortiz y su familia permanecer juntos en los Estados Unidos. Ayude a exigir que este padre pueda quedarse con sus cuatro hijes pequeños juntos de manera segura, en casa, cerca de su comunidad, médicos y familia. La deportación de Ortiz pondrá en peligro aún más el bienestar de sus hijes, pondrá en peligro su vida y nuestras comunidades se debilitarán. En cambio, buscamos que se priorice el bienestar de Ortiz y su comunidad. Buscamos mantener la integridad de su familia permaneciendo entera en Chicago.
