Demand ICE Free Jose Luis! / ¡Exige que ICE libere a Jose Luis!
In September 2023, we submitted a Stay of Removal package in Philadelphia to ask that ICE exercise discretion on his case. However, they refused to respond for months until he was in their custody. ICE sent a letter of denial to my dad’s attorneys before he even had the chance to call my family to let us know he was transferred from prison to a detention center.
ICE has denied his Stay of Removal despite his ties of almost 25 years living in Chicago. He was a legal permanent resident for seven years. He should not be punished twice for a crime he is taking accountability for.
Jose Luis, who has lived in the U.S. for over 20 years, was subjected to a prolonged trial to prove his innocence after an encounter with U.S. Customs and Border Protection in 2020. After 20 months of trial, the judge sentenced Jose Luis to 18 months at a low-risk prison, after which he expected to be released back to his family and community.
Instead of releasing him, however, ICE decided to target him, issuing an order of deportation even though Jose Luis is a legal permanent resident. Unable to secure an attorney for the immigration court procedures, Jose Luis and his family filed an asylum application based on his fear of returning to Mexico, where he is in danger of being targeted. The judge has denied his asylum application, and he is now at risk of being deported.
Jose Luis is the father of OCAD Co-Founder and current Strategic Coordinator Antonio Gutierrez. As part of our work, we uphold that "no one is disposable and no one gets left behind," a value that Antonio believes makes OCAD the space where undocumented organizing can challenge the current punitive legal system.
After being undocumented for almost two decades, Jose Luis obtained his legal permanent status in 2012 through a U-Visa process after surviving a kidnapping at his workplace. Yet even with this painful experience and ten years of living in the U.S. with status, ICE threatens to separate Jose Luis from his two adult children, his wife of almost 40 years, and two granddaughters who adore him.
Deporting Jose Luis would not only put him in danger in a country that hasn't been home to him in over two decades but would cause further harm to his wife, children, and granddaughters. Help us demand ICE stop his deportation!
José Luis, que ha vivido en Estados Unidos durante más de 20 años, fue sometido a un juicio prolongado para demostrar su inocencia después de un encuentro con la Oficina de Aduanas y Protección Fronteriza de Estados Unidos en 2020. Después de 20 meses de juicio, el juez condenó a José Luis a 18 meses en una prisión de bajo riesg, después de los cuales esperaba ser liberado de regreso con su familia y su comunidad.
Sin embargo, en lugar de liberarlo, ICE decidió atacarlo y emitió una orden de deportación a pesar de que José Luis es un residente permanente legal. Al no poder conseguir un abogado para los procedimientos judiciales de inmigración, José Luis y su familia presentaron una solicitud de asilo basándose en su temor de regresar a México, donde corre peligro de ser atacado. El juez ha denegado su solicitud de asilo y ahora corre riesgo de ser deportado.
José Luis es el padre del cofundador de OCAD y actual coordinador estratégico Antonio Gutiérrez. Como parte de nuestro trabajo, defendemos que "nadie es desechable y nadie se queda atrás", un valor que Antonio cree que hace de OCAD el espacio donde la organización de indocumentados puede desafiar el actual sistema legal punitivo.

Deportar a José Luis no sólo lo pondría en peligro en un país que no ha sido su hogar durante más de dos décadas, sino que también causaría más daño a su esposa, sus hijos y sus nietas. ¡Ayúdanos a exigir que ICE detenga su deportación!
